Legal framework of the States with respect to Artificial Intelligence.

The topic of Artificial Intelligence is not something so new, but it can be observed that lately it is booming and its notion is expanding more and more, to avoid confusion in the analysis, first, the following concept will be provided; Artificial Intelligence is the ability of a machine to present the same capabilities as human beings, such as reasoning, learning, creativity and the ability to plan, AI systems are able to adapt their behavior to some extent, analyze the effects of previous actions and work autonomously. . (European Parliament, March 26, 2021).


Based on this concept, it is of utmost importance to take into account that Artificial Intelligence is a technology with many virtues that can be applied in favor of humanity, as is the case of education, health, research, security, economy, etc. It should also be taken into account that this same technology can be used for other purposes that, far from helping, would be detrimental to society.


It is here where it makes sense to make this analysis and create discussion forums on this and other related topics since, sooner or later, all people will be exposed to this technology and others have to be discussed so that its application is the most appropriate. That is why private companies, together with the States, should not dissociate themselves, but rather there should be mutual support for the development of Artificial Intelligence and to determine how it should coexist with people, because in history we can see how the virtues of technology are not one hundred percent guaranteed.


That is why the States must take a decisive role in the regulation of Artificial Intelligence based on the current regulations, in other words, the legal framework of each country, but why not go a little further and create an international framework on this issue, because Artificial Intelligence does not know the term of borders as we do, because it is based on the digital world.


While it is true that many fields in which Artificial Intelligence can be useful were mentioned above, we should not ignore the fields in which there must be a regulation by the States, among which are the following: the use of AI as a weapon, employment, the safety of autonomous vehicles, privacy, among others. It is here where the efforts of our legislators can begin, to eliminate or reduce the risks of artificial intelligence in our daily lives, obviously this process must be accompanied by experts in the field, to avoid loopholes. It is of utmost importance to mention that some countries have already started with this work, among them; United States, China, Japan, Singapore, The European Union with a commission based on investigating AI in more depth, etc.


Finally, it only remains for me to express that although it is true that there are these fields in which AI has to be regulated, it should not be stopped, and rather it will not be stopped since many countries are at the forefront in this technological field, it is better to advance as soon as possible in a legal framework with legal rules that aim to maximize the benefits of the use of AI, protect us from the risks, resolving legal and security conflicts that may arise from its use, while promoting its development, and where AI is only at the service of the human being.
